Terms of Use
These terms are an agreement between you and Foridian LLC, a Delaware limited liability company ("Foridian", "we", "us"), for DarkGrid Hunt: the iPhone and Apple Watch apps, the website at app.darkgrid.cloud, and the services behind them (together, "the app"). By creating an account or using the app you agree to these terms and to our Privacy Policy. If you don't agree, don't use the app.
The short version: the app is a planning and navigation aid built from public records and your own data. It can be wrong. Property lines aren't surveys, season summaries aren't the regulations, and positions on the map can be late or missing. You're responsible for hunting legally, with permission, and for every shot you take.
1. Your account
- You must be at least 13 to create an account. If you're under 18, a parent or guardian must agree to these terms for you.
- Keep your sign-in details to yourself. You're responsible for what happens under your account.
- If you add a radio-only member (for example a child carrying a radio but no phone), you're responsible for that member's use of the app and for having the right to share their name and position with your party.
- Give us accurate information, and tell us at support@foridian.com if you think someone else has used your account.
2. Subscription, free trial and cancelling
- Plans. Full access needs a subscription: $9.99 a month or $79.99 a year, in US dollars, plus any sales tax that applies where you live. Prices on the checkout page, or on Apple's purchase sheet in the iPhone app, are the ones that apply. You can subscribe in the iPhone app (an App Store purchase billed by Apple) or on our website.
- Free trial. New subscribers get a 14-day free trial, once per person. You pay $0 that day. Unless you cancel before the trial ends, your subscription starts and you're charged automatically: to your Apple Account for an App Store subscription, or to the card you added for a website subscription. For website subscriptions we email you a reminder before the first charge.
- Automatic renewal. Your subscription renews automatically at the end of each month or year, and you're charged the same way, until you cancel.
- Cancelling. Cancel an App Store subscription any time in Settings → your name → Subscriptions on your iPhone, and a website subscription in Account → Manage subscription. You keep access until the end of the period you've paid for, and you won't be charged again. Deleting your account cancels a website subscription immediately. It can't cancel an App Store subscription, which only you can cancel with Apple, so cancel that first.
- Refunds. Payments aren't refundable and partial periods aren't credited, except where the law requires otherwise. Apple handles refund requests for App Store purchases (reportaproblem.apple.com). For a website subscription, if you think you were charged by mistake, email us and we'll look into it.
- Price changes. We may change prices. We'll tell you at least 30 days before a change affects your subscription, and you can cancel before it does.
- Payments are processed by Apple for App Store subscriptions and by our payment processor for website subscriptions, each under its own terms. We never see your full card number.
- Promo codes and complimentary access are personal to you, can't be sold or transferred, and may come with their own conditions. We may end complimentary access with reasonable notice.
- If a payment fails, we may pause your access until it's sorted out.
3. Map data is for reference, not a survey
- Parcel lines, owner names, acreage and public-land boundaries come from county, state and federal records and other public sources. They're often approximate, can be out of date, and can be off by many feet or more. They aren't a legal boundary survey and don't prove who owns land or where a line is.
- Seeing land in the app, or seeing it shaded as public or huntable, doesn't mean you have permission to be there or to hunt there. Posted signs, paint marks, the landowner and the managing agency decide that.
- You're responsible for getting permission to enter and hunt private land, and for obeying trespass laws.
- Imagery, terrain, water, roads and trails can be old, incomplete or wrong. Don't rely on them for safe travel.
4. Seasons and regulations are summaries
- The app summarises seasons, bag limits, legal shooting hours, draw and lottery dates and similar rules from official agency publications, and links to the source.
- Regulations change, have local exceptions, and can be misread or out of date. The official regulations, your licence and the managing agency are what count. Always check them before you hunt.
- "Legal now" and similar labels are estimates for the place and time shown, not legal advice.
5. Ballistics and range estimates
Range, drop, holdover and wind figures are calculated from the details you enter and published bullet data. Real results vary with your rifle, ammunition, conditions and many other factors. Confirm your zero and your figures at the range. You alone are responsible for every shot you take and for using firearms lawfully.
6. Party positions, radios and messages
- Positions, headings, tracks and messages shared with your party can be delayed, inaccurate or missing. Phones lose signal, radios drop packets and GPS drifts. The app isn't a safety device or an emergency service, and it doesn't tell you where everyone is. Don't rely on it for anyone's safety.
- In an emergency, call 911 or your local emergency number.
- Only share someone's position with their consent. Don't use the app to track, follow or monitor anyone who hasn't agreed to it.
- Radios. The app can configure Meshtastic-compatible radios you pair with it: name, channel and radio settings. It backs up a radio's settings before changing them, but radios are third-party hardware and firmware, and we aren't responsible for their failure, damage or lost settings. You're responsible for using radios lawfully, including radio-frequency rules where you are.
7. Your content
- Your hunt areas, waypoints, tracks, messages and notes ("your content") stay yours.
- You give us permission to store, process, copy and display your content only as needed to run the app for you. That includes showing it to the people you share it with, sending it over radio to your party, and keeping backups.
- When you share an area, its members can see what's in it, and what they add stays with the area as described in the Privacy Policy.
- You're responsible for your content and for having the right to share it.
8. Things you may not do
- Break the law with the app, including hunting, trespass, wildlife and privacy laws.
- Harass, threaten, stalk or impersonate anyone, or post content that's unlawful, abusive or infringes someone else's rights.
- Scrape, bulk-download, resell or redistribute map data, or use it to build a competing product.
- Copy, reverse engineer or interfere with the app, get around access controls, or access other people's accounts or data.
- Share your account or subscription with people outside it. Use shared areas and parties to hunt together instead.
We may remove content or suspend or close accounts that break these rules.
9. Other people's services and data
The app uses data and services from others, including county and state GIS offices, federal agencies, map and weather providers, OpenStreetMap contributors, Apple and our payment processor. Their terms may also apply, and we're not responsible for their accuracy or availability. Credits are shown in the app.
10. Changes to the app
We're improving the app all the time, so features, coverage areas and data sources may change, be added or be removed. We'll try to give notice of significant changes. The app may sometimes be unavailable for maintenance or for reasons outside our control.
11. Ending your use
You can stop using the app and delete your account at any time (see the Privacy Policy). We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering the app. If we stop offering it for reasons other than your breach, we'll refund the unused part of any prepaid subscription. Sections 3–9 and 12–15 still apply after your use ends.
12. Disclaimers
The app and all map, regulation, weather, ballistic and position information are provided "as is" and "as available". To the fullest extent the law allows, Foridian disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise that the app will be uninterrupted, error-free or secure, or that any information in it is accurate, complete or current.
13. Limit on our liability
To the fullest extent the law allows, Foridian and its members, employees and suppliers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, trespass claims, fines, licence penalties, personal injury or property damage arising from your use of the app or reliance on its information. Our total liability for any claim relating to the app is limited to the greater of the amount you paid us in the 12 months before the claim, or $50.
Some places don't allow some of these limits, so they may not all apply to you. Nothing in these terms limits liability that can't legally be limited.
14. Indemnity
If someone makes a claim against Foridian because of your content, your hunting or shooting, your entry onto land, or your breach of these terms or the law, you'll cover our reasonable costs of that claim, including legal fees.
15. Disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Please contact us first: most problems can be sorted out by email. Any dispute that isn't resolved will be heard in the state or federal courts in Delaware, and you and we agree to those courts' jurisdiction. Either of us may instead bring a claim in small-claims court where you live, if it qualifies.
16. Apple App Store
If you got the app from Apple's App Store, these terms are between you and Foridian, not Apple, and:
- Your licence is to use the app on Apple devices you own or control, as the App Store's Usage Rules allow.
- Foridian, not Apple, is responsible for the app, its content, maintenance and support. Apple has no obligation to provide maintenance or support.
- If the app fails to meet an applicable warranty, you may notify Apple, and Apple may refund any purchase price you paid it for the app. To the extent the law allows, Apple has no other warranty obligation for the app.
- Foridian, not Apple, is responsible for handling any claims relating to the app: product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer-protection claims, and claims that it infringes someone's intellectual property.
- You confirm you're not in a country under a US government embargo or on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
17. Changes to these terms
We may update these terms. We'll post the new version here with a new effective date. For significant changes we'll also tell you in the app or by email before they take effect. If you keep using the app after a change takes effect, you accept the new terms. If you don't, cancel and stop using the app.
18. General
These terms and the Privacy Policy are the whole agreement between you and us about the app. If any part is found unenforceable, the rest still applies. If we don't enforce a term straight away, we can still enforce it later. You can't transfer these terms. We may transfer them to a business that takes over the app.
